📅 Effective Date: January 1, 2025 · 📍 Carrot Custom Homes LLC

Plain English Summary: These terms govern your relationship with Carrot Custom Homes when you use our website or hire us for renovation work. We're committed to honest, transparent business — these terms protect both you and us.

Section 01

Acceptance of Terms

By accessing our website at carrotcustomhomes.com, requesting an estimate, or entering into a renovation contract with Carrot Custom Homes LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service.

If you do not agree to these terms, please do not use our website or engage our services. We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance.

Section 02

Description of Services

Carrot Custom Homes provides residential renovation and remodeling services in the Long Island and NYC Metro area, including but not limited to:

🍳 Interior Renovation

Kitchen remodels, bathroom renovations, bedroom suites, custom cabinetry, flooring, and millwork.

🏠 Whole-Home Projects

Full-scope renovations, architectural planning, and complete home transformations.

🎨 Design Services

3D renderings, material selection, space planning, and interior design consultation.

🌿 Outdoor & Specialty

Entryways, mudrooms, home offices, outdoor living spaces, and specialty room builds.

All services are subject to a signed project agreement and are contingent upon availability, permit approvals, and site conditions.

Section 03

Estimates & Project Proposals

Our free in-home consultation and written estimate are provided at no charge and with no obligation. The following terms apply:

  • Estimates are not binding contracts. A written, signed project agreement is required before any work begins.
  • Proposal validity: Written proposals are valid for 30 days from the date of issue, subject to material price changes.
  • Scope accuracy: Estimates are based on visible conditions at the time of consultation. Hidden conditions discovered during work (e.g., water damage, mold, outdated wiring) may require a change order.
  • Change orders: Any work beyond the original scope requires a signed written change order with updated pricing before proceeding.
  • Permit costs: Building permit fees are typically included in our proposals. If permit requirements change after proposal issuance, costs may be adjusted.
Section 04

Payment Terms

Payment schedules are outlined in your signed project agreement. Our standard structure is:

  • Deposit (25–35%): Due upon signing the project agreement to reserve your start date and begin material ordering.
  • Progress payments: Milestone-based payments as outlined in your specific contract (typically at demo completion, rough-in completion, and cabinet/tile installation).
  • Final payment: Due upon your approval of the final walkthrough and punch-list completion.

We accept check, bank transfer (ACH), and major credit cards. A 2.5% processing fee applies to credit card payments. We never accept cash-only arrangements.

⚠️ Late payments may result in work stoppage. Invoices unpaid beyond 15 days of due date accrue interest at 1.5% per month. We reserve the right to file a mechanic's lien on properties with outstanding balances.

Section 05

Project Conduct & Client Responsibilities

To ensure your project runs smoothly, we ask that you:

  • Provide safe, reasonable access to the project area during agreed working hours (typically Mon–Fri 7am–5pm, Sat by arrangement).
  • Clear personal belongings, furniture, and valuables from the work area prior to project start.
  • Ensure utilities (water, electricity) are available and functioning at the project site.
  • Designate a primary point of contact authorized to make decisions and sign change orders.
  • Make timely selections on materials, finishes, and fixtures when requested to avoid schedule delays.
  • Not instruct or direct our subcontractors directly — all project communications should go through your assigned Carrot Custom Homes project manager.

Delays caused by client decisions, material selection delays, or restricted site access may result in schedule adjustments and potential costs billed per the project agreement.

Section 06

Workmanship Warranty

We stand behind our work with a 5-year workmanship warranty on all completed projects.

  • What's covered: Defects in our installation, craftsmanship, and labor — including tile work, cabinetry installation, trim, plumbing fixtures we installed, and all finish carpentry.
  • What's not covered: Normal wear and tear, damage caused by misuse or improper maintenance, acts of nature, changes made by others after project completion, or manufacturer defects (covered by manufacturer warranties).
  • Manufacturer warranties: We will provide you with all manufacturer documentation for appliances, materials, and fixtures. Manufacturer warranties vary by product.
  • Making a claim: Contact us at carrotcustomhomes@gmail.com or (516) 376-5499. We will respond within 48 hours and schedule remediation within 5 business days for covered warranty claims.
Section 07

Limitation of Liability

Carrot Custom Homes carries full general liability insurance and workers' compensation coverage. Certificates of insurance are available upon request.

To the maximum extent permitted by law, our liability for any claim arising from our services is limited to the total amount paid for the specific project giving rise to the claim.

We are not liable for:

  • Indirect, incidental, or consequential damages (e.g., lost rental income, hotel costs during construction).
  • Pre-existing conditions in your home not disclosed or visible at the time of our proposal.
  • Delays caused by permit authorities, material lead times, or force majeure events.
  • Damage to personal belongings left in the work area despite our requests to clear them.
Section 08

Intellectual Property

All design work, 3D renderings, floor plans, and project drawings created by Carrot Custom Homes remain our intellectual property until final payment is received, at which point design ownership transfers to you.

We reserve the right to photograph completed projects and use images for our portfolio, website, and marketing materials. We will never use your full name or address in public materials without your explicit consent.

All content on our website — including text, images, graphics, and logos — is the property of Carrot Custom Homes LLC and may not be reproduced without written permission.

Section 09

Project Termination

Either party may terminate a project agreement with written notice under the following conditions:

  • Client termination: You may cancel the project with 10 business days written notice. You will be invoiced for all work completed, materials ordered, and reasonable overhead costs up to the cancellation date. Deposits are non-refundable after materials have been ordered.
  • Company termination: We reserve the right to terminate a project agreement due to non-payment, unsafe site conditions, or repeated failure to provide required access. In such cases, you will be invoiced for all work and materials to date.
Section 10

Governing Law & Disputes

These Terms of Service and any project agreements are governed by the laws of the State of New York. Any disputes arising from our services shall be resolved as follows:

  • First: Direct negotiation between the parties in good faith.
  • Second: Non-binding mediation through a mutually agreed mediator.
  • Third: Binding arbitration in Nassau County, New York, under AAA Commercial Arbitration Rules.

You waive the right to participate in any class action lawsuit against Carrot Custom Homes LLC.
